Default Parking problem on a rental

Ok I have a question that I am hoping someone here will be able to give some advice for.

A friend of mine rents her home and has a very nice yard with the property. Though with the permission of the landlord they added in another parking spot for the property that is close to the road. Now keep in mind that it was my friend who paid for everything to have the extra parking added and is also the one who takes care of this parking are.

Also this was added into their rental contract before the work was even started.

Ok now here is the problem, the manager of the rental properties has been giving permission to others to park there, as the manager also manages the rental property next door.

Can anything be done about this?

If it was added into thier rental contract, was there anything in that that says only for them and thier freinds and family?

Yes according to my friends contract, the extra parking was added for their friends and family to use.

I am not sure of the laws and the exact agreement,but I have a good feeling that if you to it to small claims court and showed proof that you paid for it and that you are responsible for the upkeep on it,then I would think that they would force the apartment owner to help you keep it available for you and your friends or at the least make the apartment owner pay you back for the money that you have invested in the parking spot.

I would hope that anyone could see the unfairness in your situation,and keep these landlords from running all over thier tenents.Stuff like this and worse keeps happening way to often in rental situations.

Ya thats just ridiculous. It seems as though the landlord just basically used your friend to get the parking spot made so that he could use it or allow his friends to use it. Thats not right. I would definitely tell him/her how I felt about it and if nothing changed then I'd take him/her to court.

I have given this advice to my friend, they dont like the idea of taking this to court, though apparently that is just what they are going to do. The think that they fear is that the landlord will then find ways to force them out of this rental.

Though as I told them if that were to start happening, steps can be taken to prove what is going on and then once again back into court to make it stop. I have seen and heard about this kind of stuff happening to alot of people because the landlords didnt like them so they found ways to get rid of those tenants.

Thanks everyone for helping out on this one. Its sad that things have to come to this point, but it isnt right and its not fair to those who invest the time and money only for someone else to benefit from it in the end.

Hopefully when all is said and done they will have their extra parking area once again and there wont be any further trouble from the landlord.

Update on what is going on here. Well my friend went to an attorney and spoke to him about what has been going on at the rental property reguarding the extra parking space, and showed him the contract.

Well I guess papers were drawn up and waiting for a date to be set to go before a judge to get this taken care of.

Well before that could happen the manager of the property notified my friends attorney that no one will be parking in the extra space any more. I guess the actual property owner got wind of what was going on and stepped in before things turned ugly.

So now that it has pretty much been completely taken care of there wont be a court date, also my friend recieved a refund on the costs which were paid to have the extra parking space added. The idea originally was the property owners to have this space done but the manager decided to let the tenants pay for it.

I dont think this property manager is able to perform his job very well, and will proably soon be looking for employment.

Though anyway my friend now has extra parking for visitors, there was no court date needed, and all is pretty much back to normal and happy.

Just wanted to let everyone know what has been going on.

Thanks for the update!!I knew if it was in her contract she had a good case. This shows you to make sure before you do anything when renting, it is written on papers for cases just like this one.

Yup I agree with that. Everything should be in writing and also if your dealing with a property manager always make sure that you have the contact information for the owner as well.

There are alot of property managers who will take advantage of that title as well as the tenants if at all possible with out the owners knowledge.
