Default Rental lease violations

These are just a few ways that you could be violating your rental lease. So read it over carefully and keep in mind that if you violate the lease, you may not get back your security deposit.

One way to violate your rental lease is by having guests stay over. Most leases state a period of time that guests are allowed to stay. Go over that amount of time and you have violated the agreement.

Hanging pictures is another way, theres usually a clause in the lease stating no nail holes in the walls. So get hold of your landlord and see if he allows the sticky type picture hangers on his walls.

Check your lease to see if you are responsible for changing filters in the furnace, air conditioner etc. And make sure that your house or apartment meets with the cleanliness clause that may also be in your lease.

Another thing you need to check your lease for and with the landlord is about having a water bed. A lot of places do not allow the waterbeds because of the possibility of a leak and water damage to the premises.

Also, check your lease to see if Renters Insurance is a must.

Also one other thing, if your landlord has something in the lease which you discuss with him or her and things change make sure that those changes are put into writing!!

This way you have proof that the lease had in fact changed and that what ever it was you were allowed to do.

Not everyone is crooked enough to allow you to do something then turn around after its done and say that you weren't allowed to do what ever it was. However it is always better to be safe than sorry.

Im renting an apartment in a home and I have a few questions about allowable times to break your lease without your landlord being able to do anything about it. I have a two bedroom apartment in a Victorian style home and Im the ground floor apartment. There is another apartment upstairs and one in the basement.


Now my question is if i could legally break the lease without payin for the rest of the lease time or until she found a new renter? My situation is that my bathroom window has been leaking every time it rains hard. My boys;bedroom ceiling has also been leaking whenever it rains hard. This has been going on for a year and a half without her doing anything to try to fix it. Whenever I try to talk to her about fixing it she says her handyman is busy or she can get ahold of him, ect. It is just one excuse after another. I have even had to throw toys away of my childrens multiple times after it rains. Plaster and drywall even falls anytime it leaks. Do you think there is anything I can do about it?

First off you need to take pictures of the damage. You should also write a formal letter or just go to the courthouse and set up a rent hold agreement there.

The rent that you would pay her will stay in an account until she gets these things fixed. Either way you may be able to jump out of your lease with her with no reprecutions if you handle it properly. Last thing this woman wants is an investigation that leaves her with the status of slumlord!

Sometimes in a case such as this one, since there are children involved, just the mention of turning her into the health department may get you out of your lease in a hurry.

But, make sure you have somewhere else to go in case she decides to give you a time limit for moving out.

Its a shame that people that rent dont care any more than they do.

This is only one of a multitude of things she has done. Wiht the upstairs apartment she blames everything that goes wrong on the girl that rents it an shes a single mom. She is always bugging her for money even when she is fully paided up or even over. On top of it she has the furnace for the upstairs apartment in the attic of all places. In order to get it there she had to of cut a hole in the ceiling either that or the roof. The basement has had it flood multiple times. Every renter that weve talk to that had that apartment has said that it did it to them and shes told every one of them that she didnt know about it. then us with the leaks and a cracked tub that she screwed around about replacing. Its just one thing after another with her.
